Ownership Statement

All artwork displayed or sold on this website ("the Website") is the intellectual property of Monti Sharp ("the Artist" or "we"). The Artist retains all ownership rights, title, and interest in and to the artwork, including but not limited to copyright and any other intellectual property rights.

Copyright Protection

The artwork available on the Website is protected by copyright laws and international treaties. Customers acknowledge and agree that they are purchasing only the physical artwork and do not acquire any rights to reproduce, distribute, or create derivative works from the artwork without the Artist’s explicit written permission.

License to Use

Customers are granted a limited, non-exclusive license to display the purchased artwork for personal, non-commercial use only. This license does not grant any rights for commercial use, reproduction, or distribution of the artwork without the Artist’s prior written consent.

Prohibited Uses

Customers are strictly prohibited from:

  • Reproducing, modifying, or reselling the artwork without the Artist’s express written permission.

  • Copying, scanning, or digitally reproducing the artwork in any form.

  • Using the artwork for commercial purposes, including but not limited to advertising, branding, or resale.Unauthorized use constitutes copyright infringement, and legal action may be taken.

Attribution

Customers are encouraged to properly attribute the artwork to the Artist whenever it is displayed publicly, including on social media or other online platforms.

Sales Terms

Pricing

All prices listed on the Website are in U.S. dollars (USD) and exclusive of applicable taxes. Taxes will be calculated at checkout based on the customer’s location.

Payment Methods Accepted

We accept major credit/debit cards, PayPal, and other specified payment methods. Additional fees may apply depending on the payment method chosen.

Shipping and Handling

Shipping costs are calculated based on the customer’s location and selected shipping method. Estimated delivery times vary and are subject to carrier delays and other unforeseen circumstances.

Delivery and Insurance

  • All artwork is securely packaged and shipped to the address provided by the customer.

  • Shipping insurance is optional and can be added at checkout.

  • Customers will receive tracking information once the order is shipped.

Order Confirmation

Upon placing an order, customers will receive an email confirmation containing:

  • Order details

  • Artwork title

  • Price

  • Shipping address

  • Estimated delivery date

White Glove Delivery (Premium Service)

For high-value original paintings, large limited edition prints, and custom commissions, Sharp Art Studio offers White Glove Delivery, a premium concierge-style shipping option that includes:

  • Specialized handling and packaging for maximum protection.

  • Climate-controlled transportation (where necessary).

  • Personalized delivery and placement assistance (installation may be available in select areas).

  • Priority customer service throughout the delivery process.

White Glove Delivery Terms:

  1. Inspection Required at Delivery: Customers must inspect the artwork upon arrival and report any visible damage immediately to the delivery team.

  2. Damage Claims: If damage is noticed at delivery, customers must report it within 24 hours to Sharp Art Studio.

  3. Non-Returnable After Acceptance: Once the artwork is inspected and accepted, no returns, refunds, or exchanges will be issued unless concealed damage is documented and reported within 24 hours.

  4. Rescheduling Fees: White Glove Delivery requires advance scheduling. If the customer is unavailable at the agreed-upon time, rescheduling may result in additional fees.

Order Cancellation

Orders may be canceled within 24 hours of purchase, subject to a cancellation fee.

We reserve the right to cancel orders in cases of pricing errors or unforeseen circumstances.

Availability and Substitutions

Artwork availability is subject to change and may be limited. If an artwork becomes unavailable before shipment, we reserve the right to offer a refund or substitute with a similar piece.

Dispute Resolution

Any disputes arising from sales transactions will be resolved under California law, with jurisdiction in Los Angeles, CA.

Shipping and Delivery Policies

Customer Responsibilities

  • Ensure the shipping address is accurate before completing the order.

  • Be available to receive delivery or arrange for someone to accept it.

  • For White Glove Delivery, inspect the artwork upon arrival.

International Shipping

  • Customs duties, taxes, and import fees are the responsibility of the customer.

  • Customers should check local import regulations before purchasing.

Returns Due to Shipping Issues

  • If an artwork is lost or damaged in transit, customers should contact Sharp Art Studio immediately to initiate an exchange or claim.

  • White Glove Delivery customers must report any damage at the time of delivery.

Limitation of Liability

Standard and Expedited Shipping

We are not responsible for shipping carrier delays or damage during transit if the customer declines optional insurance.

White Glove Delivery Liability

Once an item is delivered, inspected, and accepted by the customer (or their representative), Sharp Art Studio is no longer liable for damages. Customers waive the right to file a damage claim unless concealed damage is reported within 24 hours.

General Liability

Sharp Art Studio shall not be liable for:

  • Indirect, incidental, or consequential damages, including loss of profits.

  • Misuse, unauthorized reproduction, or modification of purchased artwork.

  • Third-party issues, including payment processing delays or shipping carrier failures.

Governing Law and Jurisdiction

This Terms of Service Agreement is governed by the laws of the State of California. Any disputes will be resolved in the state or federal courts located in Los Angeles, CA.

Modifications to Terms of Service

We reserve the right to update or modify these terms at any time without prior notice. Changes take effect immediately upon posting.

Notification of Updates

We may notify users via:

  • Email notifications (for registered customers).

  • Website banners or pop-ups.

  • User account dashboard alerts.

By using this Website and making a purchase, you acknowledge and agree to these Terms of Service. If you disagree, you must discontinue use of the Website and refrain from further purchases.
